Encroachment Fine Policy
The purpose of the DLPOA fine policy is to encourage prompt resolution of encroachments and to discourage repetitive encroachments.
The mechanism by which this policy will encourage prompt resolution of encroachments is to levy an automatic fine with every Letter 2. Letter 2 is sent by certified mail, which costs DLPOA money and volunteer Board Members considerable time and effort. If the directives of Letter 1 are followed, no fine will be levied. A lot owner will only receive one Letter 1 in a five year period.
If Letter 2’s directives are not fulfilled, then additional fines may be imposed by the Civic Committee.
All unpaid fines will result in a lien against the property imposed by the Civic Committee.
Fine schedule will be established by the Civic Committee.
Fine schedule established May, 2004
First Letter Two $50
Fine doubles with each subsequent offense.
For example, if a lot owner encroaches in the Summer of 2004, and does not respond in the specified time, they get a Letter Two, along with a $50 fine. Assume they pay the fine and take care of the encroachment, but then encroach again in 2005. They get another Letter Two, and a fine of $100.
