2016 Perimeter Inspection
The Perimeter Inspection was held May 13, 2016. In attendance were Carole Gannon, Terry Gannon for the Livingston side. Diane Hallinen, Andrew Kulpanowski, Trent Henry, Abigail Vance and Savannah Vance walked both the Oakland and Livingston sides. This year we wrote three letters.
We started out inspecting the Livingston side. Near post 77 a woodpile covered with a tarp was found. This is close to Main Park. Last year this wood pile was for the pig roast. Diane will ask fellow board members if this pile is needed for this year’s pig roast or if it is left over from last year.
Between posts 76 and 77, a pile of pavers, a pond, a bird house and a planted tree and many garden plants are on the common area. There are two bird houses on the common area between posts 75 and 76 and a wood pile is partially on the common area. The owners of Lot 86 had an encroachment in 2001 when the owner lived at lot 68 (posts 49 and 50), they also received an encroachment letter in 2005 for cutting down norway maples in front of their house. They denied cutting these trees. The owner also had encroachments in 2013, 2014, and last year they had a bench and brush pile on the common area. This year’s letter will be a Letter Two, which includes a fine of $50 and resolution of the encroachments. The fine is in accordance with the Encroachment Abatement Procedure and fine policy. The fee for the certified letter was $6.47.
June 16, 2016 update for encroachment Lot L 86.
The lot owner of L86 was instructed to remove the pond, pavers and other objects from the common area by June 15, 2016. Examination of the common area that was done on June 16, 2016 revealed that the pond and pavers are still on the common area. The greenbelt committee will notify the board and civic committee of this non-compliance. It is now the responsiblity of the civic committee to involve the court system so this encroachment can be resolved.
Between posts 46 and 47 we discovered a black plastic barrier that is partially on the common area. A letter was sent. This is Lot L 66. The Lot Owners report that this plastic barrier thing appears to be edging that has been on the greenbelt for a few decades. The college student work crew will remove this from the common area. The current Lot Owners of L66 have not encroached.
Between posts 41 and 42 a leaf pile was found. A letter was not sent because there was a question of when these leaves were placed on the common area. This lot was recently purchased by a new owner. This is lot L 11.
Between posts 16 and 16.5 we found a leaf pile. A letter was sent. This is lot L 32. Please remember to refrain from dumping yard waste on the common area.
We did not find any encroachments on the Oakland side. Post 106 is down. The greenbelt committee prefers not to be involved with post placement as this could be perceived as a conflict of interest. There were some brush piles that appear to have been a result of Edison’s work. There are areas that appear to have excessive leaf litter that are near lot lines, but the groups consensus was that they appear to be old and not definite encroachments. We had hoped to do a prescribed burn this past spring, but the last snow, and frequent rains during the burn period prevented us from doing the burn. We plan on trying again in spring 2017 and will target these leaves.
